DuPont reaches an out-of-court settlement with Spanish refrigerant reseller
Settlement concerns unauthorized sale of patented R-422D retrofit refrigerant
DuPont and Star Refrigeration (Glasgow, U.K.) have reached an out-of-court settlement with the Spanish refrigerant reseller, Eccogas Refrigerants S.A. (Martorelles/Catalonia), concerning the sale of product R-422D not coming from DuPont or an authorized source. Although details were not disclosed, DuPont and Star acknowledge that the settlement will prevent any future unauthorized sale of R-422D by Eccogas.
DuPont is the sole licensee under a Star Refrigeration patent covering R-422D, a non-ozone-depleting refrigerant broadly used to retrofit and service commercial refrigeration and building air conditioning equipment. Product R-422D marketed by DuPont under the trademark ISCEON® MO29 is part of the DuPont™ ISCEON® family of non-ozone depleting retrofit refrigerants. These refrigerants have become the leading choice in Europe to enable equipment owners to continue to operate equipment designed for HCFC-22 refrigerant despite the ban of virgin HCFC-22 for service in the European Union.
“DuPont and Star Refrigeration secured evidence of alleged patent infringement in Spain regarding the R-422D refrigerant,” said Diane Iuliano Picho, global business manager – DuPont Refrigerants. “We are pursuing strong action to stop illegal trade of R-422D in the European market. Enforcement of refrigerant IP rights provides customers the assurance of continued access to high quality and lawfully sourced refrigerant from reliable and reputable suppliers.”
